Terms of Service

These public terms describe the baseline rules for using Afrastic. Signed order forms, enterprise agreements, and customer-specific terms control where they conflict.

Acceptance

By accessing or using Afrastic, you agree to these Terms of Service on behalf of yourself and, where applicable, the organization you represent.

If you use Afrastic under a separate written agreement, the written agreement controls if there is a conflict with these public terms.

Accounts and administrators

  • Customers must provide accurate account, billing, gym, staff, and contact information.
  • Customers are responsible for assigning appropriate roles, removing users who should no longer have access, and protecting login credentials.
  • Users must not share passwords, bypass 2FA, access accounts they are not authorized to use, or interfere with security controls.

Customer data

Customers control the gym, member, billing, attendance, staff, and communication data entered into Afrastic. Afrastic may process that data to provide the service, support customers, secure the platform, and comply with legal obligations.

Customers are responsible for having the required rights and notices for member data, including contact details, billing records, attendance history, photos, emergency information, and communication preferences.

Subscriptions, trials, and plan limits

  • Afrastic subscription pricing, member limits, trial windows, and WhatsApp bulk quotas are defined by the active plan catalog or a signed order form.
  • Some features are gated by plan. Custom terms, SLAs, integrations, migration help, or volume arrangements may require an Enterprise agreement.
  • Unless a written agreement says otherwise, taxes, telecom costs, third-party provider charges, and payment processing fees are separate from platform subscription fees.

Acceptable use

  • Do not use Afrastic for unlawful, harmful, deceptive, abusive, infringing, or unauthorized activity.
  • Do not upload malware, attack the service, probe infrastructure without permission, or attempt to access another tenant.
  • Do not send messages to people who have not agreed to receive them, or continue sending after a person opts out.
  • Do not use Afrastic to store sensitive data that is not needed for gym operations or that your organization is not authorized to process.

Messaging and integrations

Afrastic includes communication workflows such as WhatsApp and email where configured. Customers are responsible for message content, recipient consent, opt-out handling, and compliance with telecom, platform, and provider rules.

Biometric attendance integrations, where enabled, are for attendance event logging and member matching. Afrastic does not claim to control physical doors, turnstiles, or biometric template custody unless a signed integration agreement expressly says so.

Availability and support

Afrastic works to keep the platform available, secure, and supported. Specific uptime, support response, backup, migration, or onboarding commitments must be stated in a written agreement or plan terms.

Suspension and termination

Afrastic may suspend or limit access when needed to protect the service, enforce these terms, comply with law, prevent harm, or address non-payment. Customers may stop using the service according to their subscription or written agreement.

Intellectual property

Afrastic and its software, design, branding, documentation, and platform technology remain owned by Afrastic or its licensors. Customers retain their rights in customer data.

Disclaimers and liability

Afrastic is provided as business operations software. It is not legal, tax, accounting, payment, medical, or safety advice. To the maximum extent allowed by law, Afrastic disclaims warranties not expressly stated in a written agreement and limits liability according to the applicable agreement or law.

Changes

Afrastic may update these public terms from time to time. Material updates will be reflected by changing the last updated date and, where appropriate, notifying affected customers.
